1. INTRODUCTION

General Terms
PLEASE READ THE ENTIRE TERMS OF USE BEFORE USING ABABIL.

These Terms of Use are an agreement between Users (“You”, “Your”, or “Yourself”) and Ababil, a company established under the laws of the United States and based in the USA ("Ababil", “We”, “Us”, or “Our”). These Terms of Use govern your use of the Ababil website (www.myababil.com and other sites we manage), content, and products provided by us and/or our partners (collectively referred to as the “Services”), as well as any orders, payments, or use of services provided through our platform (referred to as “Services”).

By agreeing to these Terms of Use, you also agree to any additional terms, such as any changes made to these Terms of Use (together referred to as the “Terms of Use”). Additional terms supersede these Terms of Use in case of any discrepancies.

Using Ababil and Services
Accessing and using the website are subject to these Terms of Use.

You have the choice to use our platform or others, and whether to use the services available on our platform.

We provide the platform to connect you with various services you need. These services are offered by third-party partners (“Service Providers”), such as business owners, drivers, delivery providers, and merchants. Some services require location access and we keep you updated on your order processing.

2. WHAT YOU NEED TO KNOW ABOUT ABABIL

Before you start using the Ababil, you need to agree to our Terms of Use and Privacy Notice and register by providing some information. During registration, we'll ask for your full name, email address, and valid mobile phone number to create your account ("Account"). You can update your profile information anytime in Ababil's settings.

Once you've registered, our system will send a verification code via text message to the mobile number you provided. You'll need to enter this code to complete the verification process.

After verification, your personal account will be linked to your email or mobile number, allowing only one account per email or mobile number. However, you can create multiple spaces within a single account as needed.

If you get logged out of your account, you'll need to enter your email address or mobile number and the verification code sent to your registered mobile number to log back in.

Remember, never share your verification code with anyone, including us or anyone claiming to represent us.

Your Rights and Grant of Rights in Content

You retain full ownership of any content you submit, post, or display on or through Ababil. What belongs to you remains yours — you own your content, including any audio, photos, and videos that are part of it.

By submitting, posting, or displaying content on or through Ababil, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content across any and all media or distribution methods currently known or developed in the future. This includes, for example, curating, transforming, and translating your content. This license allows us to make your content available to a global audience and to permit others to do the same. However, if you choose to limit the distribution of your content to a restricted community through our features, we will respect your choice. You also agree that this license includes our right to analyze the text and other information you provide to improve our services. This license further includes our right to provide, promote, and enhance the services, and to make the content you submit to or through Ababil available to other companies, organizations, or individuals for syndication, broadcast, distribution, reposting, promotion, or publication on other media and services, in line with our terms and conditions for content use. This additional usage by us or by other companies, organizations, or individuals does not entitle you to compensation, as your use of Ababil is agreed upon as sufficient compensation for the content and the rights granted herein.

As Ababil is an Islamic social media platform, all content must adhere to Islamic law. You acknowledge that any content you submit, post, or display will not contain material that violates Islamic principles or is subject to copyright or other proprietary rights unless you have the necessary permission or are otherwise legally entitled to post the material and grant us the license described above.

We maintain a set of evolving guidelines to ensure that our ecosystem partners interact with your content in ways that respect your rights and adhere to Islamic law. You understand that we may modify or adapt your content as it is distributed, syndicated, published, or broadcast by us and our partners, and may make changes to your content to adapt it to different media, all within the bounds of Islamic principles.

You represent and warrant that you have obtained all necessary rights, licenses, consents, permissions, power, and/or authority to grant the rights granted herein for any content you submit, post, or display on or through Ababil. You agree that your content will comply with Islamic law and will not contain any material that contravenes these principles.

Device Authentication Features
If your device supports fingerprint or facial recognition features, you can use them to log in to our platform, if supported.

Please note that we don't store this biometric data. It's stored on your device or by third parties like your device's manufacturer. We're not responsible for any unauthorized access or loss of this data.

If you get a new device, you'll still need the verification code to log in. You can enable the device authentication feature on your new device in the settings.

Rates and Fees

Our platform is free for users to access and use. However, organizations are required to pay a fee for using the platform to process payments, sell products or services, or collect donations. These fees help us maintain and improve the platform's services. In the future, we may adjust these fees as necessary to better accommodate the needs of both users and organizations.

You can pay for services using cash or electronic payment methods provided by third-party payment providers, such as electronic money, debit/credit cards, or other methods.

However, currently, for payments, Ababil partners with Stripe, a trusted payment processing platform. Your payment details are securely handled by Stripe, ensuring the protection of your financial information and compliance with industry standards. Stripe facilitates various payment methods, including KYC (Know Your Customer) payment authentication, offering you a seamless and secure payment experience. Your payment information is encrypted and handled securely by Stripe, and Ababil does not store or access your full payment details. We reserve the right to refuse or delay your payment request for various reasons, including suspicion of fraud or violations of our terms or laws.

Donations & Loans

Donations
All donations made through the platform are voluntary and non-refundable. By making a donation, the user acknowledges that they are not entitled to receive any goods, services, or other benefits in return. Donations will be used strictly for the purposes outlined by the receiving organization or cause. The platform is not responsible for the misuse of funds by third-party organizations. Donors should consult with tax advisors regarding the eligibility of tax deductions for donations. The platform does not provide tax advice. Donors may receive a confirmation receipt via email from the organization after completing their donation. This receipt should be kept for tax or record-keeping purposes. Currently, we do not offer any option to cancel or refund donations once they are made. Donors are advised to carefully review all details before confirming their contribution.

Lending Money
Users lending money to others through the platform do so at their own risk. The platform does not guarantee repayment or assume any responsibility for the borrower’s ability to repay the loan. The specific terms of repayment, including the timeline and any interest (if applicable), should be clearly agreed upon between the lender and the borrower before the transaction. The platform may facilitate this process but does not enforce these terms. If a loan is provided as a "good loan" or Qard Hasan (an interest-free loan), the lender agrees not to charge interest or any other fees beyond the principal amount lent. The borrower commits to repaying the loan according to the agreed-upon schedule. The lender assumes all risks associated with the borrower’s default. The platform is not liable for any losses incurred due to non-repayment. In the event of a dispute regarding the terms of a loan, the lender and borrower are encouraged to resolve the matter amicably. The platform does not mediate disputes but may provide tools to facilitate communication between parties.

Good Loan (Qard Hasan)
The platform supports the concept of Qard Hasan, where users can lend money to others without interest for charitable or benevolent purposes. The lender provides this loan with the expectation of repayment but without financial gain. Borrowers are expected to repay the Qard Hasan loan in full within the agreed-upon period. Both parties should clearly communicate and document the repayment terms. The platform may facilitate the connection between lenders and borrowers but does not guarantee or enforce the repayment of Qard Hasan loans. Users participate in these transactions at their own risk. Borrowers receiving a Qard Hasan loan are expected to use the funds for the purpose agreed upon with the lender. Misuse of the loan may result in a loss of trust and future borrowing opportunities. The lender and borrower are solely responsible for all transactions related to lending money and Qard Hasan. We simply provide the platform for this, without deriving any benefit. It is up to them to ensure trust and the return of funds. These terms and conditions help protect both parties involved in donations and loans while ensuring that the platform operates transparently and ethically.

3. PERSONAL INFORMATION

Any personal information you provide during account setup, like your name, contact details, and location, is subject to our Privacy Notice.

Content Information
We may provide third-party content on Ababil. If these are provided by others working with us, we're not responsible for them. Your access to or use of third-party content or offers is subject to their terms and conditions, as well as our Privacy Notice.

Third-party content includes things like text, images, videos, and links or services provided by third-party content providers.

You agree to use these offers according to their terms and won't abuse or misuse them.

Our Platform
We only offer the official Ababil platform through our authorized website, which is designed for use on web browsers and mobile devices. Accessing the platform from unauthorized sources or using it on unsupported devices violates our terms and conditions.

We may update the platform from time to time to improve functionality and provide a better user experience. These updates may occur automatically or require your action. It is important to regularly install or accept updates to ensure optimal performance.

Please note that if you don't apply updates, the platform may not function properly or may cease to work altogether. Additionally, the latest version of the platform will always take precedence in the case of any discrepancies between versions.

Your Account
Your Ababil account is personal to you and cannot be transferred to others for any reason. We reserve the right to refuse to process orders or transactions if we suspect your account has been transferred or used by someone else without your authorization.

It's your responsibility to keep your account secure and confidential, including your registered name, email address, mobile number, payment details, and verification codes. If you're negligent in maintaining this security, any losses incurred are your responsibility. We consider any activity or orders made through your account as authorized by you.

If you suspect unauthorized use of your account, notify us immediately. We'll take necessary actions to address unauthorized use.

Account Deactivation
If you want to deactivate your Ababil account or unlink it from other third-party platforms, if applied, you can do so within the Ababil platform or by contacting support@myababil.com.

Your Statement

To maintain compliance with our policies and ensure the safety of our users, the following age restrictions apply for creating an Ababil account:

1. Minimum Age Requirement: Users under the age of 13 are prohibited from creating an account on Ababil.

2. Age 13 to 18: Users within this age range may create an account, but they are required to provide contact information for a legal guardian. This can be done either by linking the Ababil account to the guardian's Ababil account or by providing a valid email address or phone number for verification purposes.

Ababil reserves the right to verify the accuracy of the information provided. If any inaccuracies or discrepancies are identified, we retain the authority to suspend or terminate the account without prior notice.

You acknowledge that any risks associated with using the platform are your responsibility, and you release us from any claims arising from unauthorized access or system disruptions caused by third parties.

You agree to comply with Google Maps' terms of service and privacy policy when using our platform as it utilizes Google Maps data.

You acknowledge that Ababil is a technology company and does not directly provide transportation, logistics, financial, or other services. These services are provided by third parties.

By continuing to use the platform, you agree to comply with applicable laws and our terms of use. If you disagree with any part of these terms, you should stop using our services immediately.

Your Responsibility
You're responsible for all decisions made using your Ababil account. Treat service providers and other parties respectfully, and refrain from engaging in unauthorized or harassing behavior. You're fully responsible for any losses or claims arising from the use of the platform or services using your account, in violation of our terms, privacy notice, or applicable laws.

Intellectual Property
The Platform and Services, encompassing names, logos, program codes, designs, trademarks, technologies, databases, business processes, and models, are safeguarded by copyright, trademark, patent, and other intellectual property rights as per the laws of the United States, registered either by us or our affiliates. We, along with our licensors, hold all rights and interests pertaining to the Platform and Services, inclusive of all associated intellectual property rights.

Under these Terms of Use, we provide you with a limited, non-exclusive, revocable, and non-transferable (without the right to sublicense) license to (i) download, access, and utilize the Platform in its current state, solely on your personal mobile phone and/or tablet for the purpose of utilizing the Service, and (ii) access or use content, information, and related materials available on the platform solely for personal, non-commercial purposes. All rights and privileges not explicitly granted herein are reserved by us or our licensors.

Any reproduction, distribution, creation of derivative works, sale or offer to sell, or display, in part or in whole, and usage of the platform and/or Services, whether digitally or otherwise which contravene these Terms of Use or the intended purposes set by us, constitutes a violation of our intellectual property rights.

You are prohibited from:

• Removing any copyright, trademark, or other ownership notices contained within the Platform or Services.
• Replicating, modifying, adapting, translating, creating derivative works, distributing, licensing, selling, transferring, publicly displaying, reverse engineering, transmitting, moving, broadcasting, decompiling, or disassembling any part of the Platform or its components for exploitation, including software, features, and Services therein.
• Licensing, sublicensing, selling, reselling, removing, transferring, distributing, or commercially exploiting the Platform and/or software by creating internet “links” to the Platform or by framing or mirroring any software on other servers or wireless or internet-based devices.
• Initiating automated programs or scripts, such as bots, viruses, or any program that may create excessive server requests, causing heavy burdens or impeding the operation and/or performance of the Platform.
• Using site searching or retrieval applications or other manual or automatic devices for scraping, indexing, surveying, data mining, or in any manner replicating or circumventing the navigation structure or presentation of the Platform or its contents.
• Publishing, distributing, or reproducing materials, whether copyrighted, trademarked, or otherwise owned by us, without prior written consent from us or the rights owners who license us the rights.
• Using or unofficially accessing the Platform to (a) damage, weaken, or jeopardize any aspect of the Platform, Services, or related systems and networks, and/or (b) create competing products or services resembling the Platform in ideas, features, functions, or graphics.

4. PROBLEM RESOLUTION AND DISPUTE SETTLEMENT

Troubleshooting
If you encounter any issues such as system failures, suspecting unauthorized access to your account, or if your device is lost, stolen, or compromised, please inform us immediately. We'll take necessary actions to prevent further misuse or loss.

For any problems with the services, third-party content, offers, or payments, you can submit your complaint using the provided feature or by contacting us directly. To ensure effective resolution, please provide sufficient information, including a summary of the issue, any evidence you have, and relevant details like order numbers and personal information.

Upon receiving your complaint, we'll verify the provided information and may ask for additional details if needed. If the information doesn't match our records or if the complaint isn't valid, we may not be able to assist further.

If necessary, we may forward your complaint to the relevant service provider or payment method provider for resolution between you and them directly.

Temporary and Permanent Account Suspension

Your account may be suspended temporarily or permanently if:

• You report unauthorized access or misuse of your account.
• Your device is compromised or lost.
• We suspect your account has been transferred or used by someone else.
• Any actions that could harm us, you, or others.
• Use of multiple accounts on one device to violate our terms.
• Unusual activities detected on your account.
• Legal incapacitation or governmental orders.
• Violations of our terms or applicable laws.

If you believe your account should not be suspended, you can report evidence to us for review. We'll assess the situation and decide whether to lift the suspension.

Rooted or Jail-broken Devices

Using Ababil on modified devices may compromise security and lead to risks. We're not liable for any issues arising from using the platform on rooted or jail-broken devices. We reserve the right to suspend usage on such devices if necessary.

Actions We May Take
If we suspect any immoral or unlawful actions from you, we reserve the right to suspend your account, investigate, report to authorities, or take legal action as necessary.

Limitation of Liability
We provide Ababil as is and do not guarantee its reliability, accuracy, or suitability. We're not responsible for any losses or damages resulting from service providers, third-party content providers, or payment method providers.

Governing Laws and Dispute Resolution
This agreement is governed by the laws of the United States of America. Any disputes will be subject to the exclusive jurisdiction of the appropriate courts within the United States. However, we encourage discussing and resolving any issues directly with you/us first.

5. MISCELLANEOUS

Upon registering for an Account by clicking the 'register' button or accessing Your Account by clicking 'log in', you acknowledge and agree that this Terms of Use constitutes an electronic agreement. Your action signifies your active consent to enter into a legally binding agreement with Ababil, which remains valid as long as you use the Ababil platform or Services.

You agree not to dispute the validity of this Terms of Use or the Privacy Notice, both of which are presented in electronic format. You are not permitted to transfer your rights under this Terms of Use without prior written consent from Ababil. However, Ababil reserves the right to transfer its rights under this Terms of Use to any party at any time without prior approval or notification to you.

Failure to comply with the provisions of this Terms of Use does not waive Ababil's rights to take necessary actions in the future, even if immediate action is not taken.

This Terms of Use remains in effect even if the platform is temporarily suspended, permanently suspended, or deleted, or if the agreement between You and Ababil expires. The unenforceability of any provision in this agreement will not affect the enforceability of other provisions.
